General terms of use and data confidentiality
I. OBJECTIVES
1. Docmatics is an online platform consolidating coordinated information about medical professionals and non-medical specialists. It provides users (hereinafter called "users") with access to qualified medical information.
2. Through Docmatics, no medical services are offered, and no medical activities are 2 performed following the Health Act, the Medical Establishments Act, and other normative acts in the field of healthcare
II. SERVICES
1. Services provided to users of qualified medical information (users) - Docmatics ensures technical capabilities for users regarding:
a) Registering and maintaining their profile on the Docmatics network, with one physical a person not being allowed to register more than one profile;
b) Updating and supplementing the information published by the user in their profile;
c) Rating and sharing comments about medical professionals and other non-medical specialists already registered on the Docmatics network by users who have received professional assistance at a healthcare facility from the respective medical professional;
d) Booking a free appointment from the profile of the chosen medical professional using the "Book Appointment" service.
2. Services provided to medical professionals and other non-medical specialists with confirmed profiles - Docmatics ensures technical capabilities for medical professionals with confirmed profiles regarding:
a) Maintaining their profile on the Docmatics network, with one medical professional not being allowed to register more than one profile, nor are groups of medical professionals allowed to register a joint profile;
b) Updating and supplementing the information published in the medical professional's profile;
c) Access to a database of reviews and ratings made by Docmatics users;
d) Receiving automatic bookings from users for a free appointment using the "Book Appointment" service.
3. Users of qualified medical information can use publicly available services on Docmatics for free. Docmatics does not require them to pay a fee for registering a profile, confirming a registered profile, or updating or supplementing the basic information published in the profiles of users of qualified medical information.
4. Docmatics reserves the right to introduce fees for certain services, committing to inform users through comprehensive information published in the Terms and Conditions for Use of Docmatics.
5. By registering on Docmatics, users agree to receive commercial messages from the platform and its partners, but Docmatics does not share users' data with these partners. Users can withdraw their consent at any time by deleting their profile and ceasing to use the services offered by Docmatics.
III. RIGHTS AND OBLIGATIONS OF USERS OF QUALIFIED MEDICAL INFORMATION
1. Users of qualified medical information have the right to register and maintain a profile on the Docmatics network containing the following data: name, email address, and phone number.
2. Users of qualified medical information agree that by using the "Book Appointment" service with a medical professional with a confirmed profile on Docmatics, this medical professional or another non-medical specialist receives access to the data from the profile of the user of qualified medical information to establish contact if necessary, acquire preliminary information about the user of qualified medical information, exchanging details regarding the reservation, treatment, etc.
3. Users of qualified medical information agree that by using the "Book Appointment" service with a medical professional with a confirmed profile on Docmatics, they will receive notifications from Docmatics in the form of electronic messages (emails and web push notifications) related to the confirmation, cancellation, and reminders for upcoming appointments with a medical professional or another non-medical specialist with a confirmed profile on Docmatics, as well as for other purposes and activities of Docmatics.
4. The obligation of users of qualified medical information when using the "Book Appointment" service with a medical professional or another non-medical specialist with a confirmed profile on Docmatics is to ensure that the appointment is correctly booked, meaning that the reservation appears in "Upcoming Appointments" in the section "My Reservations" in the user's profile and that an email confirming the appointment has been received at the email address with which the user is registered.
5. Users of qualified medical information can update and supplement the information published in their profile.
6. Users of qualified medical information have the right to terminate their registration on Docmatics at any time by emailing contacts@percepticus.com, upon which their profile will be deleted, and they will be informed of the deletion. The message must be sent from the email with which the users are registered on the platform to verify account ownership.
7. Users of qualified medical information agree that Percepticus EOOD processes their data and is accessible to doctors or medical centers where they have made an online reservation solely to carry out this online reservation and the examination with the doctor. To provide the requested service to users of qualified medical information, Percepticus EOOD may use subcontractors, for which it informs them accordingly. Users of qualified medical information can withdraw their consent by emailing contacts@percepticus.com.
8. Percepticus EOOD reserves the right to store only the emails of users with qualified medical information who engage in malicious behavior, with the aim of blocking their ability to re-register on the platform.
9. Users of qualified medical information are obliged not to publish false data, data belonging to other physical and legal entities (which do not have legal grounds to represent), data, information, messages, comments, and any other statements that could be considered offensive and damaging to the prestige of medical professionals with profiles on Docmatics and/or third physical or legal persons, institutions, state authorities, and/or organizations, misleading, containing threats and/or violating good morals, as well as statements containing calls for violence and/or inciting violations and circumvention of legal norms.
10. Users of qualified medical information are obliged not to publish statements, messages, comments, and any other information on the Docmatics platform that could be perceived as commercial messages under the Electronic Commerce Act and/or as advertising under the Competition Protection Act.
11. Percepticus EOOD does not require users and medical professionals with profiles on Docmatics to provide personal data that reveals racial or ethnic origin, political, religious, or philosophical beliefs, membership in political parties or organizations, associations with religious, intellectual, political, or trade union aims, or that relates to health, sexual life, or human genome. Publishing by a user or medical professional with a profile on Docmatics, in their profile and/or in the profiles of other users of Docmatics, information, messages, comments, and any other statements containing and disclosing their own and/or others' data relating to: racial or ethnic origin; political, religious, or philosophical beliefs, membership in political parties or organizations, associations with religious, intellectual, political, or trade union aims, health, sexual life, or human genome, is a voluntary action carried out at the user's discretion, with Percepticus EOOD not bearing responsibility for such actions. By publishing in their profile and/or in the profiles of other users of Docmatics information, messages, comments, and any other statements containing and disclosing their data from the categories listed above, the user expresses explicit consent for the published personal data to be disclosed to other users of the Docmatics platform.
12. Users of qualified medical information are obliged, if necessary, to cancel or change the date or time of their reservation via the "Cancel" or "Reschedule" link in the "Upcoming Appointments" section. Changes can be made up to 120 minutes before the appointment. If they do not cancel or attend the reserved appointment, the doctor can mark the users of qualified medical information as "No Show." More than one no-show and too many reservation changes can lock the profile.
Blocking reported users policy: If a user is reported as not having shown to an appointment three times, their ability to book appointments is blocked for 30 days from the last report. They can still login to their profile for other uses of the system. Each temporary block counts toward a total of three lockouts; on the third lockout the account is permanently blocked and login is disabled. Reported no-shows may be resolved by the doctor, which updates the count accordingly and reverts a lockout if the user had been blocked with the resolved no-show report.
13. Users of qualified medical information agree that the work of medical professionals and other non-medical specialists involves extraordinary situations in which they can change or refuse the reserved appointment, for which users of qualified medical information will be immediately notified. On the day of the appointment, unforeseen situations may also arise, and in this case, some waiting may be possible despite the reservation being made.
14. Users of qualified medical information agree that by using any of the services offered by Docmatics, they are considered familiar with and accept the Terms and Conditions for Use of Docmatics.
15. Users of qualified medical information bear direct and full responsibility for damages caused and administrative and property sanctions related in any way to their actions and/or statements carried out in violation of any point of the Terms and Conditions for Use of Docmatics.
IV. RIGHTS AND OBLIGATIONS OF MEDICAL PROFESSIONALS AND OTHER NON-MEDICAL SPECIALISTS
1. Medical professionals and other non-medical specialists have the right to create their profile on the Docmatics platform by providing the following information: full name, specialty, city or other location where they practice medicine, email address, contact phone number, professional experience, education, additional qualifications, practice address, working hours, examination fees, and other relevant information.
2. Medical professionals and other non-medical specialists can update and supplement the information in their profiles.
3. Medical professionals and other non-medical specialists are not allowed to publish on the Docmatics platform any information, messages, comments, or other statements that could be interpreted as an attempt to provide or compose a final medical opinion, diagnosis, prescription for specific medications and/or therapies, or medical consultation in any other form. Suppose they publish information that may be perceived as a final medical opinion, diagnosis, prescription, or consultation. In that case, they must clearly state that the publication has only informational purposes and does not constitute medical consultation, diagnosis, or prescription, which falls within the scope of medical activities according to health care regulations.
4. Medical professionals and other non-medical specialists are not allowed to publish on the Docmatics platform false data, data belonging to other individuals or legal entities, data, information, photos, messages, comments, and other statements that can be considered offensive, damaging to prestige and/or infringing on the copyrights of a user of Docmatics and/or third parties, institutions, government agencies, and/or organizations. They also cannot publish misleading, threatening, and/or morally inappropriate statements and those containing calls for violence and/or encouraging violations and circumvention of legal norms.
5. Medical professionals and other non-medical specialists cannot publish any statements, messages, or other information on the Docmatics platform that can be perceived as commercial messages under the Electronic Commerce Act and/or advertising under the Competition Protection Act.
6. By using any service offered by Docmatics, medical professionals and other non-medical specialists are deemed to be aware of and accept the platform's General Terms and Conditions.
7. Medical professionals and other non-medical specialists bear direct and full responsibility for damages caused and administrative and property sanctions related to their actions and/or statements that violate any point of the General Terms and Conditions for using Docmatics.
8. Medical professionals and other non-medical specialists must always keep the information in their profile and calendar up-to-date. They must accept users who have booked an appointment through the platform at the specified time. In case of an inability to fulfill the reservation, they must cancel it within the allowed deadlines through the platform to notify the users.
9. Medical professionals and other non-medical specialists are responsible for complying with all applicable regulatory requirements for practicing their profession.
V. GENERAL AND FINAL PROVISIONS
1. Docmatics reserves the right to terminate without notice the registration of any user or medical professional and other non-medical specialist with a profile on the platform who violates any point of the General Terms and Conditions for using Docmatics.
2. Systematic refusal, change of appointments, or other malicious behavior from users of qualified medical information, as well as from medical professionals and other non-medical specialists, can also lead to immediate termination of their registration without notice.
3. Docmatics is not responsible for and has the right to remove published content from users, medical professionals, and other non-medical specialists that includes false data, data belonging to different physical and legal entities, data, photos, information, messages, comments, and any other statements that could be considered offensive and damaging to the reputation of a user of Docmatics and/or third parties, institutions, government agencies, and/or organizations, misleading, containing threats and/or violating good morals, as well as statements containing calls for violence and/or encouraging violations and circumvention of legal norms.
4. Docmatics is not responsible for published statements, messages, and any other information from users, medical professionals, and other non-medical specialists with profiles on the platform that can be perceived as commercial messages under the Electronic Commerce Act and/or advertising under the Competition Protection Act.
5. Docmatics moderates patient reviews to ensure they are objective and useful for doctors and other users. Before publishing opinions, follow these principles: Do not publish reviews that reveal personal information about doctors or patients; do not publish comments unrelated to the examination itself, your opinion about the doctor, and your experience as a patient with the given specialist.
6. Docmatics is not responsible for the accuracy, correctness, or currency of the data published in the profiles of users, medical professionals, and other non-medical specialists.
7. Docmatics is not responsible for copyright infringements committed by users or medical and non-medical specialists with profiles on the platform.
8. Docmatics is not obligated to update and maintain the data published in the profiles of users or medical and non-medical specialists with profiles on the platform.
9. Reports, inquiries, and complaints regarding violations of these General Terms and Conditions for using Docmatics, as well as other questions related to the platform's operation, use, and functioning, can be submitted by users via email to contacts@percepticus.com.
10. Amendments and additions to these General Terms and Conditions for using Docmatics become effective upon publication and are binding on all platform users.
11. Percepticus EOOD takes necessary technical and organizational measures to protect data from accidental or unlawful destruction, accidental loss, unauthorized access, alteration, or dissemination, and other unlawful forms of processing.
12. Percepticus EOOD implements special measures to protect processed data during electronic transmission. These measures comply with modern technological achievements and ensure a level of protection corresponding to the risks associated with processing and the nature of the data to be protected.
